PakLinked, Inc. ("PakLinked," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. This Copyright Policy outlines our procedures for addressing claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA)and applicable U.S. copyright law.
This policy applies to all content posted on PakLinked, including but not limited to text, images, videos, documents, and other materials ("User Content").
1. Copyright Ownership and User Rights
1.1 You Own Your Content
You retain all ownership rights to the content you create and post on PakLinked ("Your Content"). PakLinked does not claim ownership of Your Content.
1.2 Responsibility for Your Content
By posting content on PakLinked, you represent and warrant that:
- You are the copyright owner of the content, or have obtained all necessary rights, licenses, consents, and permissions to post it
- The content does not infringe, violate, or misappropriate any third party's copyright, trademark, patent, trade secret, moral rights, or other intellectual property rights
- You have the right to grant the licenses described in this Copyright Policy and our User Agreement
- The content complies with all applicable laws and regulations
1.3 Violation of These Representations
Violation of these representations may result in immediate termination of your account and potential legal liability. You agree to indemnify PakLinked for any damages resulting from your copyright infringement.
2. License Grant to PakLinked
2.1 Content License
By posting Your Content on PakLinked, you grant PakLinked a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:
- Use, reproduce, and store Your Content on our servers and systems
- Display and distribute Your Content to other users according to your privacy settings
- Modify and create derivative works for technical purposes (e.g., formatting for different devices, creating thumbnails, transcoding videos)
- Publicly perform and display Your Content on the PakLinked platform
- Sublicense these rights to our service providers and partners to the extent necessary to operate the Services
2.2 Scope of License
This license is limited to operating, developing, providing, promoting, and improving the Services. We will not use Your Content for purposes unrelated to the Services without your consent.
2.3 Duration of License
This license continues until you delete Your Content or close your account. However, the license may continue for content that has been shared with others and that they have not deleted, or for content retained in backup systems for a reasonable period (not exceeding 30 days after deletion).
Note: If other users have reshared, quoted, or otherwise incorporated Your Content into their own content, that content may remain visible even after you delete the original.
3. DMCA Notice and Takedown Procedure
PakLinked complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We will respond to valid DMCA takedown notices and remove or disable access to allegedly infringing material.
3.1 DMCA Safe Harbor
PakLinked is a service provider under the DMCA and qualifies for the safe harbor provisions. We are not liable for copyright infringement by our users if we:
- Promptly remove or disable access to allegedly infringing material upon receiving proper notice
- Have no actual knowledge of the infringement
- Do not receive financial benefit directly attributable to the infringing activity
- Have designated a Copyright Agent to receive infringement notices
3.2 Our Response Process
Upon receiving a valid DMCA notice, we will:
- Remove or disable access to the allegedly infringing content
- Notify the user who posted the content
- Provide the user with a copy of the DMCA notice
- Inform the user of their right to file a counter-notification
4. Filing a DMCA Copyright Complaint
If you believe that content on PakLinked infringes your copyright, you may submit a DMCA takedown notice to our Copyright Agent. Your notice must include all of the following information:
Required Elements (DMCA § 512(c)(3)):
- Signature: A physical or electronic signature of the copyright owner or person authorized to act on behalf of the owner
- Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notification, a representative list of such works
- Identification of Infringing Material: Identification of the material that is claimed to be infringing, with sufficient detail to allow us to locate it (e.g., URL of the post, profile URL, specific description)
- Contact Information: Your contact information including name, mailing address, telephone number, and email address
- Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
⚠️ Warning About False Claims
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees. Submitting a false DMCA notice may result in civil liability and criminal prosecution for perjury.
4.1 Sample DMCA Notice Format

5. Copyright Agent Contact Information
All DMCA notices, counter-notifications, and other copyright-related correspondence should be sent to our designated Copyright Agent:

This agent is designated solely for receiving notifications of claimed copyright infringement under the DMCA. Any other inquiries will not receive a response.
Note: For expedited processing, please send DMCA notices via email to copyright@paklinked.com. We will respond to valid notices within 2-3 business days.
6. Counter-Notification Procedure
If you believe that content you posted was removed or disabled by mistake or misidentification, you may file a DMCA counter-notification pursuant to 17 U.S.C. § 512(g).
6.1 Required Elements of Counter-Notification
Your counter-notification must include:
- Signature: Your physical or electronic signature
- Identification: Identification of the material that was removed and the location where it appeared before removal (e.g., URL)
- Penalty of Perjury Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Consent to Jurisdiction: Your name, address, phone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Southern District of Texas if your address is outside the United States), and that you will accept service of process from the person who filed the original DMCA notice or their agent
6.2 Our Response to Counter-Notification
Upon receiving a valid counter-notification, we will:
- Forward a copy of the counter-notification to the original complainant
- Inform them that we will restore the removed content in 10-14 business days
- Restore the content in 10-14 business days unless our Copyright Agent receives notice that the complainant has filed a court action to restrain you from engaging in infringing activity
⚠️ Warning About False Counter-Notifications
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be subject to liability for damages. Submitting a false counter-notification may result in civil liability and criminal prosecution for perjury.
7. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, PakLinked has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.
7.1 What Constitutes a Repeat Infringer
A "repeat infringer" may include, but is not limited to:
- A user who has received two or more valid DMCA takedown notices within a 12-month period
- A user who repeatedly posts content that is clearly infringing despite warnings
- A user whose content has been removed through final court judgments for copyright infringement
7.2 Consequences
Users identified as repeat infringers will have their accounts terminated and may be permanently banned from using PakLinked's Services. We reserve the right to make the final determination as to whether a user is a repeat infringer.
7.3 Appeals
If you believe your account was terminated in error, you may contact us at copyright@paklinked.com to request a review. However, we are under no obligation to reinstate terminated accounts.
8. PakLinked Intellectual Property
8.1 PakLinked Trademarks and Copyrights
All PakLinked logos, trademarks, service marks, trade names, trade dress, and other distinctive brand features ("PakLinked Marks") are the exclusive property of PakLinked, Inc. and are protected by U.S. and international trademark and copyright laws.
8.2 Platform Content and Software
The PakLinked platform, including its software, design, layout, graphics, text, and other content (excluding User Content), is owned by PakLinked and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
8.3 Restrictions on Use
You may not, without our prior written permission:
- Use, reproduce, or display PakLinked Marks for any purpose
- Copy, modify, distribute, or create derivative works of PakLinked's platform or software
- Reverse engineer, decompile, or disassemble any part of our Services
- Frame or mirror any part of the PakLinked website
- Use any automated system (bots, scrapers) to access or collect data from PakLinked
8.4 License to Access Services
Subject to your compliance with our User Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use our Services for your personal, non-commercial use.
9. Fair Use and Exceptions
PakLinked respects the doctrine of fair use under U.S. copyright law (17 U.S.C. § 107) and other statutory exceptions to copyright infringement.
9.1 Fair Use Factors
When evaluating copyright complaints, we consider the following fair use factors:
- The purpose and character of the use (commercial vs. educational, transformative vs. reproductive)
- The nature of the copyrighted work (factual vs. creative)
- The amount and substantiality of the portion used
- The effect of the use on the potential market for the original work
9.2 Examples of Potential Fair Use
While we make no guarantees, the following uses may qualify as fair use:
- Criticism and commentary on publicly available works
- News reporting and journalism using brief excerpts
- Educational use in non-profit contexts
- Parody or transformative works that add new meaning or message
- Brief quotations in professional or academic discussions
Note: Fair use is determined on a case-by-case basis. We encourage users to seek legal advice if unsure whether their use qualifies as fair use. If you believe your content was removed despite being fair use, you may file a counter-notification.
10. International Copyright Considerations
PakLinked is based in the United States and operates under U.S. copyright law. However, we respect international copyright protections.
10.1 Berne Convention
The United States is a signatory to the Berne Convention for the Protection of Literary and Artistic Works. Copyright works from Berne Convention member countries are protected in the U.S. and vice versa.
10.2 Non-U.S. Copyright Holders
Copyright holders located outside the United States may file DMCA notices with our Copyright Agent. The same procedures and requirements apply regardless of your location.
10.3 Local Laws
While we respect local copyright laws, we can only process copyright complaints that comply with U.S. law and DMCA procedures. If you have concerns under non-U.S. copyright law, please consult with legal counsel in your jurisdiction.
11. Modifications to This Policy
We may update this Copyright Policy from time to time to reflect changes in our practices or legal requirements. When we make material changes, we will:
- Update the "Last Updated" date at the top of this policy
- Notify users via email or in-platform notification (for significant changes)
- Post the updated policy on our website
Your continued use of PakLinked after the effective date of the updated policy constitutes acceptance of the changes.

This policy is governed by the laws of the State of Texas, USA. Any disputes arising from copyright matters will be resolved in accordance with our User Agreement and applicable law. This Copyright Policy is incorporated into and forms part of the PakLinked User Agreement.
